The Court of Appeal has intervened by granting a stay of execution on the High Court’s ruling that nullified the election of Eng Dr Michael Moses Odongo Okune as the Paramount Chief of Lango. This decision means that Eng Odongo Okune will continue in his role pending the appeal process, effectively suspending the High Court’s declaration that his election was illegal.
Justice Cheborion Barishaki, who issued the ruling, emphasized the potential “irreparable harm” Eng Odongo Okune could face if the High Court’s decision were implemented immediately. He noted that Eng Odongo Okune had made significant personal and professional adjustments upon assuming the role of Paramount Chief, including resigning from his job and cultural responsibilities.
The High Court had initially ruled in favor of Benjamin Okii and Denis Obia Acila, challenging Eng Odongo Okune’s election, asserting that the outgoing Paramount Chief, Mzee Yosam Odur Ebii, retained rightful leadership. The court had directed the Minister of Gender, Labour, and Social Development to remove Eng Odongo Okune from the Paramount Chief position. Dissatisfied with this decision, Eng Odongo Okune promptly appealed to the Court of Appeal, arguing procedural correctness in his election.
