The case was filed by city lawyer Steven Kalali, who argued that ULS had denied other members the opportunity to participate in the election of their representatives to various statutory bodies.

Kalali asserted that the actions of ULS leadership in handpicking members to serve on various statutory bodies, infringe on the rights of members, including the right to freedom of expression.

In his ruling delivered on February 2, 2024, Justice Wamala agreed with Kalali, stating that appointing representatives without them going through an election largely contravenes the ULS Act and Election Regulations.

Some of the statutory bodies mentioned in Kalali’s complaint include the Media Council, Judicial Service Commission, and Anti-Pornographic Control Committee.

“I have found a breach of the provisions of the ULS Act and the Election Regulations. I accordingly issue an order of permanent injunction restraining the respondent’s council from any further breach of the Act and the Election Regulations regarding the election of the Society representatives,” ruled Wamala.

Kalali argued that representatives to various statutory bodies should be elected or nominated with the approval of the members.
